DUSHANBE, February 4, 2011, Asia-Plus -- Press Cafe of the project "Strengthening the Socioeconomic Development of Rural Population of Tajikistan, Through Expanded Application of the Methods of Alternative Legal Procedure for Dispute and Conflict Resolution" was held at the National Hall of Tajikistan Hotel in Dushanbe on February 3.
The Press Cafe was organized in the framework of the program "Won State Actors" funded by the European Union and implemented by the Arbitrazh public association and National Association of Small and Medium Business of Tajikistan.
The goal of the press cafe was to provide with the information the representative of the governmental authorities, donor organization, international community and NGOs, also mass media regarding the project activity.
The project will implement three main following activities: 1) strengthening the legislation on issues connected with solution of disputes and alternative legal procedure; 2) reinforcement of SME''s role in dispute resolution through alternative legal procedure; and 3) communication and awareness services.
Tajikistan is gaining a vast experience during establishment and development of Arbitration courts. The idea of conciliation procedure which has been transformed currently in the Law "On Third Party Arbitration Court" purports to resolve a dispute in the regular court without an expensive judicial procedure. This idea is corresponded to the judicial reform conducted in the Republic of Tajikistan. However, such a paradoxical approach to resolving a dispute is very complicated for the psychological perception by absolute majority of population the mentality of which was not used to such method of resolving disputes. Meanwhile, according to the Law "On Third Party Arbitration Court", a decision made by the arbitration court has the same legal validity along with the decision of the regular court.
