DUSHANBE. May 27. “Asia-Plus” -- Today, May 27, special commission set up by the Tajik State Antimonopoly Service under the Government of Tajikistan has passed a decision on violation of the legislation of Tajikistan by the Innovative Road Solutions (IRS) company which manages the Dushanbe-Chanak toll highway.
According to the decision, in the next month the company should comply with the requirements specified in the commission’s decision. “Otherwise, the antimonopoly service reserves the right to hand the case to the Tajik High Economic Court,” head of the commission and chairman of the Tajik Antimonopoly service Amonullo Ashur reported.
The Antimonopoly service accuses IRS of a series of violations of the antimonopoly legislation and a range of other legislative and normative acts of Tajikistan, including the Principal Law – the Constitution of the country.
According to the decision, the company should remove all gaps and violations of elementary consumers’ rights which were found in the company’s pricing policy and so forth.
Tajik Antimonopoly service started its investigation of violation of the antimonopoly legislation of Tajikistan by IRS on May 17 this year.
Earlier head of the Tajik Antimonopoly Service Amonullo Ashur suggested the commission that studies the situation around Dushanbe-Chanak toll road to revise the contract between the Government of Tajikistan and IRS in terms of its correspondence to requirements of Tajikistan’s legislation, normative and legal acts.
“This contract contradicts the notion of concession and lacks elementary attributes which should be specified in such contracts such as legal address of the company, bank details and some other things,” he said.
