DUSHANBE, June 25, 2008, Asia-Plus  -- Deputies of the Majlisi Namoyandagon (Tajikistan’s lower chamber of parliament) have endorsed a new administrative code in the first reading.  Presenting the code, Tojiddin Tourayev, member of the Majlisi Namoyandagon Committee on Constitution, Legislation and Human Rights, has noted that the administrative code currently in force was adopted in 1985 already and numerous amendments made to it just sophisticated its sense and made implementation of it difficult.  Therefore, the head of state offered the new administrative code that has been considered by parliamentarians during six months, Tourayev said.    

A regular sitting of the fourth session of the Majlisi Namoyandagon of the third convocation, presided over by its chairman, Saydullo Khairulloyev, was held on June 25.  

Speaking at the session, Tourayev said that the new administrative code provides for protecting human rights and freedoms, providing supremacy of law and unavoidability of punishment.  The new code also specifically determines types of administrative infringements and types of punishment for them, according to him.

He added that under the new administrative code, administrative cases may be considered not only by courts but also by 36 various institutions, including bodies of justice, anticorruption agency, customs service, energy supervision, land-management agency, agency for standardization, communications regulatory agency, military recruitment offices, etc.  

MP Shodi Shabdolov suggested that it should be taken into account that administrative infringements could be made by inspecting and investigating bodies as well.  

The Majlisi Namoyandagon speaker Khairulloyev proposed to take that proposal into consideration while preparing the document for the second reading.
